1. Copyright Policy Overview

GlitchRealm respects the intellectual property rights of others and expects users to do the same. This policy outlines procedures for reporting copyright infringement under the Digital Millennium Copyright Act (DMCA) and Canadian copyright law.

GlitchRealm will respond promptly to valid takedown notices and may terminate accounts of repeat infringers.

3. Filing a DMCA Takedown Notice

If you believe your copyrighted work has been infringed on GlitchRealm, submit a written notice containing:

Required Elements

  1. Identification of the copyrighted work: Describe the work you believe has been infringed (title, registration number, or detailed description)
  2. Identification of the infringing material: Provide the URL or specific location on GlitchRealm where the infringing content appears
  3. Contact information: Your name, address, phone number, and email address
  4. Good faith statement: A statement that you have a good faith belief the use of the material is not authorized by the copyright owner, its agent, or the law
  5. Accuracy statement: A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf
  6. Physical or electronic signature: Your handwritten or electronic signature

4. Response to Takedown Notices

Upon receiving a valid DMCA notice, GlitchRealm will:

  1. Remove or disable access to the allegedly infringing material within 48-72 hours
  2. Notify the user who posted the content (if identifiable)
  3. Provide the user with a copy of the takedown notice
  4. Document the removal for repeat infringer tracking

Content will remain removed unless a valid counter-notice is received (see below).

5. Filing a DMCA Counter-Notice

If your content was removed due to a DMCA notice and you believe the removal was erroneous or the content is not infringing, you may file a counter-notice containing:

  1. Identification of the removed material: Describe the content that was removed and its prior location
  2. Good faith statement: A statement under penalty of perjury that the material was removed by mistake or misidentification
  3. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court (if in the U.S.) or Alberta courts (if in Canada)
  4. Contact information: Your name, address, phone number, and email
  5. Physical or electronic signature: Your handwritten or electronic signature

Send counter-notices to: dmca@glitchrealm.ca with subject line "DMCA Counter-Notice"

6. Response to Counter-Notices

Upon receiving a valid counter-notice, GlitchRealm will:

  1. Forward the counter-notice to the original complainant within 2-3 business days
  2. Wait 10-14 business days to allow the complainant to file a court action
  3. Restore the content if no court order is received within the waiting period

7. Repeat Infringer Policy

GlitchRealm maintains a policy of terminating accounts of users who are repeat copyright infringers. Factors considered include:

  • Number of valid DMCA takedown notices received against a user
  • Severity and nature of infringement (wholesale copying vs. fair use disputes)
  • User's response to notices (compliance, counter-notices, patterns of behavior)

Accounts may be suspended or permanently terminated after 3 valid takedown notices (or sooner for egregious violations).

8. False or Fraudulent Notices

Submitting a false or fraudulent DMCA notice may result in:

  • Legal liability for damages (including attorney's fees) under 17 U.S.C. § 512(f)
  • Perjury charges if the statement is knowingly false
  • Banning from filing future notices with GlitchRealm

Only submit notices if you genuinely believe your copyright has been infringed.

9. Canadian Copyright Law

In addition to the DMCA (which applies to U.S. users), GlitchRealm complies with the Copyright Act (Canada). Canadian users may also submit notices under the "notice and notice" regime:

  • Copyright holders send notices to GlitchRealm
  • GlitchRealm forwards notices to users without immediate content removal
  • Users have the opportunity to cease infringement voluntarily

10. Fair Use and Exceptions

GlitchRealm respects fair use, fair dealing, and other copyright exceptions under U.S. and Canadian law. Examples include:

  • Commentary, criticism, news reporting, teaching, scholarship, or research
  • Parody, satire, or transformative works
  • Non-commercial personal use (limited scope)

If you believe your content qualifies as fair use/fair dealing, include this defense in your counter-notice.

12. Changes to This Policy

GlitchRealm may update this DMCA policy at any time. Changes will be posted on this page with an updated "Last updated" date.
